New Swiss Data Protection Act

As of September 1, 2023, the new Swiss Data Protection Act (n DPA) came into force.

Adaptation of the old legislation dating back to 1992 was necessary to ensure that the EU continues to recognize Switzerland as a partner with an adequate level of data protection, thus maintaining the competitiveness of Switzerland as a business location.

The main changes concern:

- the protection of genetic and biometric data of natural persons, which are considered sensitive data;

- software, equipment and services that must be configured with automatic data protection measures;

- the right to inform data subjects of the collection of personal data;

- the obligation to establish a register of processing activities.

To be considered beyond minor adjustments, companies that have adapted to the European Union's GDPR do not have to make significant changes.
